Tonight, #Trump's team released their 37-page recusal motion. That means that Merchan -- who ordered last month that both sides need his express permission before filing further pre-trial motions -- allowed them to do so.
Trump's justification for a second recusal motion, after his first motion was denied last August, is that there are both changed circumstances and newly discovered evidence. #legal
Recall also that the standard for recusal that Trump's team invoked necessitates finding that the judge knew or should have known his daughter has an interest that would be substantially affected by this case
& it bears note that Merchan sought guidance from a state judicial ethics advisory board before Trump filed his 1st motion. The advisory opinion is dated May 4, 2023, which means the request from Merchan came even sooner. Trump did not file his motion until 5/31 of last year
I tell you this because while many Democratic candidates and campaigns are clients of Merchan's daughter's firm, the online communications cited in the new motion were made, with 2 exceptions, between 3/30/23 and 4/10/23, weeks before Trump's first motion.
@GottaLaff If a judge is responsible for his family's work and behaviour, then Clarence Thomas is out, right? His wife's behaviour reflects more on him than someone's adult child, living away from home, living their own.
Or how about how Amy Coney Barrett, Brett M. Kavanaugh & Neil M. Gorsuch committing Perjury when they were all under oath in front of the Senate applying for their jobs & said "Roe V Wade is settled law"? Then overturned it as soon as they could.
I can't believe they are not all fired considering the job they have!!!
